12• CASH ON DELIVERY:

13. FINANCIAL DETAILS:
You/User agree, understand and confirm that the credit / debit card details or other financial details provided by you for availing of services on the Website will be correct and accurate and you shall not use the credit /debit card or financial facility which is not lawfully owned / obtained by you. 14• SENSITIVE PERSONAL DATA OR INFORMATION:
14.1 The sensitive personal data or information as described in the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, shall be dealt in the manner prescribed under the Rules, the parent Act and the LLP/body corporate/Http://theofen.com//shall be complying with all future laws, rules, regulations for protecting the sensitive personal data or information.

15. CANCELLATION& REFUND:
15.1 Cancellation by http://theofen.com/: There may be certain request that http://theofen.com/are unable to accept and deliver and these may need to be cancelled. Some situations that may result in your order being cancelled include, non-availability ofservice in the address/location provided by the user/customer, inaccuracies or errors in pricing information, product unavailability, or problems identified by http://theofen.com//credit and fraud avoidance department. http://theofen.com/may also require additional verifications or information before accepting any order. http://theofen.com/will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card or bank account has been charged, the said amount will be reversed back in your credit card / bank account.\

15.4 You, as a Buyer/purchaser, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier or within a reasonable time. In case you do not raise a refund claim using Website/application features within the stipulated time than this would make You ineligible for a refund. 15.5 You will be responsible for the cost of returning the item to us, unless we delivered it to you in error or it is faulty/wrong. You must send the item back to us immediately on receipt of the same and no later than 7 days from the day you received the product, by following the instructions we send you or following the online instructions provided in our site.
15.6 Except for Cash On Delivery transaction, refund, if any, shall be made at the same Issuing Bank from where Transaction Price was received after deduction of the online transaction charges.
15.7 For Cash On Delivery transactions, refunds, if any, will be made via demand draft in favour of the Buyer/Purchaser as per registration details provided by the Buyer/Purchaser or as per account details entered in his User account with http://theofen.com//and verified by the Http://theofen.com//team.
15.8 In case of orders placed from foreign countries i.e., from any country outside India for delivery to location outside India, the cancellation of the order shall not be accepted after payment is received and the order is processed. Wherever eligible for refund, the Http://theofen.com//coupons shall be issued equivalent to the consideration paid for the item/product which shall reflect in the User account of the customer maintained with Http://theofen.com//or in the alternative to be sent to the email id of the customer used while purchasing at http://theofen.com/.
15.9 Shipping charges if already incurred by the LLP/Http://theofen.com//shall not be refunded if the goods/product already despatched by the LLP/http://theofen.com/.Cash on Delivery option shall not be available for foreign purchases i.e., purchases made for delivery in any country other than India.
15.10 ‘http://theofen.com/’ or the ‘SWISS BAKERIE AND PATISSERIE PVT LTD’ is reliant on third parties such as banks to deliver timely Services and process refund. Since, ‘http://theofen.com/’ or the ‘SWISS BAKERIE AND PATISSERIE PVT LTD’ cannot control the actions of such third parties, ‘http://theofen.com/’ or ‘SWISS BAKERIE AND PATISSERIE PVT LTD’ will not be responsible to render Services or process payments or refunds on the following days (“Non – Working Days”): • days which are declared as holidays by the RBI, or any other day which is declared a holiday by Us. • days including Saturdays and Sundays and declared as bandhs or festivals in any State or Union Territory in India. We will continue to render Services which do not involve that particular State or Union Territory in which a bandh or festival has been declared on that day.
16• RETURN & REPLACEMENT:
16.1 Though http://theofen.com// or the SWISS BAKERIE AND PATISSERIE PVT LTD makes all effort to deliver the product in time and the right product to you but the customer/purchaser may place request for return of the product which shall be solely accepted/not accepted as per the terms and conditions and internal guidelines/policies of http://theofen.com//the LLP as decided from time to time.
16.2 In most cases the return shall either give rise to refund or replacement.
16.3 In no cases the refund/replacement request shall be processed/grantedfor fault/mistake on the part of the customer/purchaser.
16.4 Wherever the refund or replacement request has been processed and accepted, the refund or the replacement shall be done only after receiving back the goods/product by http://theofen.com//the LLP wherever applicable.

16.8 After receipt of the goods/product by the SWISS BAKERIE AND PATISSERIE PVT LTD/http://theofen.com/, all request shall be processed immediately and wherever eligible for refund/replacement endeavor shall be made to complete the refund/replacement within next 7 working days after receipt back of the product by the LLP.
16.9 All shipping and other replacement charges shall be borne and incurred by the SWISS BAKERIE AND PATISSERIE PVT LTD when the refund/replacement request is arising due to fault/mistake on the part of the SWISS BAKERIE AND PATISSERIE PVT LTD/http://theofen.com/. And in all other cases the shipping charges for processing the goods/products shall be borne by the customer/purchaser.
16.10 The customer/purchaser shall never misrepresent facts or conceal facts or state facts for illegal gain and the SWISS BAKERIE AND PATISSERIE PVT LTD/http://theofen.com//reserves all right to take legal/appropriate actions wherever it is found that customer/purchaser misused the refund/replacement policy of the SWISS BAKERIE AND PATISSERIE PVT LTD/http://theofen.com//through misrepresenting facts or concealment of facts or stating facts for illegal gain.
16.11 No product(s) shall be accepted for refund/replacement in used condition. All products shall be returned to the SWISS BAKERIE AND PATISSERIE PVT LTD/http://theofen.com//in unused condition.

19• LIMITATION OF LIABILITY:
19.1 ‘SWISS BAKERIE AND PATISSERIE PVT LTD’ or ‘http://theofen.com/’ shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services, even if SWISS BAKERIE AND PATISSERIE PVT LTD or http://theofen.com//has been advised of the possibility of such damages. 20. EXTENT OF ACCESS& LICENSE:
